In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and the Guidelines issued by the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI), INMOBILIARIA BASAC makes this Comprehensive Privacy Notice available to its clients, suppliers, employees, partners, and the general public.

The legal entities responsible for collecting your personal data will be the controlling, subsidiary, or affiliated companies within the corporate group of “INMOBILIARIA BASAC”, S.A. de C.V., a variable capital stock corporation, legally established and registered in the United Mexican States, operating under the name: “INMOBILIARIA BASAC”, designating as the registered office for all legal purposes the one located at:

Avenida Bonampak, Manzana 3, Lote 11, Local C- 109 Int. A, Condominio Palmeras, Cancún, Benito Juárez, Quintana Roo, C.P. 77500.

By means of this document, you are hereby informed that the personal, asset, or financial data you have provided to this company by any means, including emails, faxes, form submissions, phone calls, contracts, mail, business cards, digital media, etc., will be processed strictly under the principles of lawfulness, consent, information, quality, purpose, loyalty, and responsibility.

 

II. DATA COLLECTED.

INMOBILIARIA BASAC collects the following personal data, which is illustrative but not exhaustive

  1. Identification: Name, address, nationality, place and date of birth, age, marital status, tax ID number (RFC), unique population registry code (CURP), handwritten signature, official identification number, and immigration documents.
  2. Contact:Personal or institutional phones, emails.
  3. Labor and professional: Occupation, Profession, position or post, activity or line of business.
  4. Financial assets:Income, expenses, bank accounts, bank statements, credit history, real estate, public deeds, utility bills, tax receipts, guarantor or co-signer information, data for loan processing.
  5. Operation data: Contracts, purchase agreements, leases, contract validity, and rental amounts.
  6. Personal or work references.
 

INMOBILIARIA BASAC does not request sensitive data, except for that which is strictly necessary to comply with applicable contractual or legal obligations.

 

III. PURPOSES OF PERSONAL DATA PROCESSING.

INMOBILIARIA BASAC”, be advised that the personal data provided by you will be used to:

A. Primary purposes (required):

  1. Formalize and carry out real estate brokerage operations (purchase and sale, leasing, administration, or marketing of real estate properties).
  2. Elaborate and formalize contracts, purchase agreements, and leases.
  3. Verify and confirm the identity, tax status, and financial solvency of the holder.
  4. Carry out procedures before notaries, financial institutions, INFONAVIT, FOVISSSTE, tax authorities and other municipal, state or federal agencies.
  5. Evaluate the quality of services and comply with the obligations arising from the legal relationship.
 
B. Secondary purposes: (optional):
  1. Sending information about services, promotions, or properties of interest to you.
  2. Development of studies and satisfaction surveys.
  3. Back contact for future real estate operations or projects.
  4. Custom access to our web portal and digital platforms.

Should you decide not to hire our real estate services, we also suggest you remain in our updated database so we can contact you and give you priority access to our products and services.

Personal data will be kept under the strictest confidentiality and may not be used for purposes other than those mentioned above, unless there is a change in this Privacy Notice.

 

IV.ARCO RIGHTS.

Article 28 of the LFPDPPP grants you four rights to exercise:

  • Access to your personal data held by the responsible party, to be informed of the Privacy Notice and its purposes.
  • Rectify your data if it is inaccurate, incorrect, or outdated.
  • Cancel your personal data when you consider that it is not being used to fulfill the purposes established in this Privacy Notice.
  • To oppose the processing of your personal data for any of the purposes set forth in this Privacy Notice..
 

INMOBILIARIA BASAC”, shall not be obligated to delete personal data when it falls under any of the circumstances established by law, including the following: when it pertains to the parties of a private, social, or administrative contract and is necessary for its execution and fulfillment; when it must be processed by legal provision or order of a competent authority, and its deletion would hinder judicial or administrative actions related to tax obligations, prosecution of crimes, or the enforcement of administrative penalties; when it is necessary to protect the legally safeguarded interests of the data subject; when it is necessary to fulfill a legally acquired obligation by the data subject; and when it is subject to processing in accordance with the Federal Law for the Prevention and Identification of Operations with Illicit Proceeds (LFPIORPI) and other applicable regulations regarding the prevention of money laundering and terrorist financing. 

 

In these cases, personal data will be retained exclusively for the time required to fulfill the corresponding legal obligations, applying the necessary administrative, technical, and physical security measures for its safeguarding.

 

V. OPTIONS AND MEANS TO LIMIT THE USE OR DISCLOSURE OF DATA.

  2. Sign up for the Public Registry to Avoid Advertising (REPEP) of PROFECO: www.profeco.gob.mx.

 

VI. MECHANISMS FOR THE EXERCISE OF ARCO RIGHTS AND REVOCATION OF CONSENT FOR THE PROCESSING OF YOUR DATA.

To exercise your rights of Access, Rectification, Cancellation, and Opposition or your right to revoke consent for the processing of your personal data, you must submit a written statement explaining what you believe is appropriate regarding the misuse or rectification of your personal data, sent to the following email address: mgodoy@costarealty.com.mx, along with a copy of an official ID and complying with the requirements outlined in Article 29 of the LFPDPPP regulations. Alternatively, you may submit your written statement physically, in Spanish, in accordance with the requirements established in the aforementioned article, at the address specified in subsection (I) of this Privacy Notice. The response will be issued within a maximum period of 5 business days indicating whether the request is admissible or inadmissible as provided by the LFPDPPP.


VII. DATA TRANSFER.

The personal data that has been provided to us will not, at any time, be disclosed or shared with third parties, meaning that for the purposes of this Privacy Notice, the following cases shall not be considered a third party.:

  1. With affiliated or subsidiary companies of the same corporate group.
  2. With real estate offices, associate agents, or members of any real estate association for brokerage operations.
  3. With banking institutions, notary offices, law firms, or accounting firms.
  4. With real estate marketing platforms (for example: Inmuebles24, Vivanuncios, internal CRMs).
  5. With competent authorities, when required by court order or legal provision.
 

Likewise, the data may only be shared for the purpose of collaboratively carrying out the necessary procedures for the real estate brokerage activity related to the purchase, sale, leasing, or administration of real estate properties.

Third parties to whom your personal data is transferred will be bound by the same terms of this Privacy Notice and will comply with the respective security and confidentiality measures..Likewise, we are obligated to transfer your personal data to third parties without your consent, under the principles of lawfulness, consent, information, purpose, loyalty, proportionality, and responsibility, only for the cases established in Article 37 of the LFPDPPP, as well as to carry out such transfer in accordance with the terms of the aforementioned Law..

 

VIII. REVOCATION.

The holder of the personal data may revoke their consent for the processing of personal data at any time, in accordance with Article 8 of the LFPDPPP. For this purpose only, they must send their request through a free-form written document to the Personal Data Officer: Mrs. Margarita Godoy Ávila, either by courier to the address or to the email mentioned in subsection (VI) of this Privacy Notice.

Likewise, the holder of the personal data is informed that “INMOBILIARIA BASAC” will have a period of 7 calendar days to address their request, and the response will inform them about the outcome of their petition.

We reserve the right to modify or update this Privacy Notice at any time or as a result of regulatory changes, internal needs, or new data protection practices. Updates will be available through any of the following means:

We will not be responsible if you do not receive the notice of change to the Privacy Policy due to any problem with your email account or internet data transmission.
